Terms & Conditions of Website Use 1. The generation and forwarding of an order by you (the "Customer") using the online shop at www.ovariancancer.net.au constitutes an offer to purchase the products from Prodigy Merchandise Pty Limited ("Prodigy"). All orders are subject to acceptance by Prodigy. 2. Nothing in these terms and conditions operates to exclude, restrict or modify the application of any provision, condition or warranty, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other statute, where to do so would contravene that statute, or cause any part of this clause to be void ("Non-excludable Obligations"). 3. General Terms and Conditions of Sale 1. Scope: All goods and services ("Products") supplied by Prodigy Merchandise Pty Limited ("Prodigy") are supplied on these terms and conditions. 2. No Exclusion of Obligations: Nothing in these terms and conditions operates to exclude, restrict or modify the application of any provision, condition or warranty, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other statute, where to do so would contravene that statute, or cause any part of this clause to be void ("Non-excludable Obligations"). 3. Order Acceptance: No order shall be binding on Prodigy until accepted by Prodigy. Prodigy reserves the right to accept any order in whole or in part. Where Prodigy makes a part delivery of any order, such delivery shall constitute a separate contract. Subject to clause 6 (Delivery), no order may be cancelled or varied by the Customer after acceptance by Prodigy, other than due to a breach of these terms and conditions by Prodigy, or a failure to comply with a Non-excludable Obligation. 4. Payment Terms: All orders must be paid for via valid credit card at the time of order placement. 5. Title to Products: Ownership of the Products does not pass to the Customer until the Customer has discharged all outstanding indebtedness, whether in respect of the Products or otherwise, to Prodigy. Risk in the Products will pass on delivery to the Customer. 6. Delivery: Prodigy reserves the right to charge for delivery of the Products at any time, notwithstanding that it may not have previously done so. Where Prodigy charges for delivery of a Product after an order has been placed and paid for, Customers are entitled to cancel their order, and obtain a full refund for the Product, if they do not agree to the new delivery charges. If in stock, Products will be delivered within 3-5 days of being ordered. If the Product is not in stock, Prodigy will advise the Customer of an expected delivery date. 7. Exclusion: Except in relation to Non-excludable Obligations, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied by statute, custom or the common law are excluded from these terms and conditions. 8. Limitation - General: Except in relation to Non-excludable Obligations, Prodigy and Ovarian Cancer Australia shall have no liability for any loss, harm, damage, cost or expense (including legal fees), or any special, indirect or consequential loss or damage (including, without limitation, economic loss, loss of contract, loss of profit or revenue, loss of opportunity, loss of production, production stoppage or loss of data) arising directly or indirectly under or in connection with the supply of the Products, whether by way of indemnity, statute, in tort (for negligence or otherwise), or on any other basis in law or equity. 9. Limitation – Non-excludable Obligations: Except for goods or services of a kind ordinarily acquired for personal, domestic or household use or consumption, Prodigy's liability for a failure to comply with any Non excludable Obligation (other than a guarantee as to title, encumbrances or quiet possession conferred by the Australian Consumer Law) is limited to: (a) in the case of services, the cost of supplying the services again and payment of the cost of having the services supplied again; and (b) in the case of goods, the cost of replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired. 10. Conflicts: These terms and conditions will apply to the exclusion of all other terms and conditions contained in the Customer's order. In the event of any inconsistency, Prodigy will be deemed, by delivering the Products to the Customer or supplying services to the Customer, to have made an offer to the Customer to sell the Products or supply the services pursuant to these terms and conditions, which offer will be deemed to have been accepted if the Customer retains the Products or accepts the services. Prodigy reserves the right to change these Terms and Conditions at any time. 11. GST: Prodigy reserves the right to recover from the Customer all goods and services tax ("GST") payable in respect of the supply of goods and services to the Customer. 12. Jurisdiction: These terms and conditions are governed by and will be construed in accordance with the laws of Victoria and the parties agree to submit to the jurisdiction of the courts of that state. 13. No Waiver: The failure by Prodigy to exercise, or any delay in exercising, any right, power or privilege available to it under these terms and conditions will not operate as a waiver thereof or preclude any other or further exercise thereof or the exercise of any other right or power. Ovarian Cancer Australia supports the importance the community places on the maintenance of confidentiality of individuals’ personal and/or sensitive information. This extends to the collection and management of information held in its records regarding individuals. We understand that a person’s experience of ovarian cancer is very personal and we do not want anyone to feel uncomfortable about the information we keep. For donors, it may also include credit card or other financial details. Where we collect sensitive information, we only do so with the consent of the individual and where it is provided voluntarily or authorised by law. No one is obliged to provide any information and consent to hold particular information can be withdrawn at any time.
